1. What is a City Charter?

According to the National League of Cities, a city charter is the basic document that defines the organization, powers, functions and essential procedures of the city government. It is comparable to the Constitution of the United States or a state’s constitution. The charter is, therefore, the most important legal document of any city.

3. Why do we amend the Charter?

From time to time, cities seek to revise their charter as new practices or ideas are brought forth by ordinance or electors. In Section 3.11, the current Oviedo City Charter states that at least once every 5 years, the City Council shall appoint a Charter Review Committee to recommend additions, deletions, or changes to the City Council for consideration.

4. When will I be able to vote for the Charter Amendments?

If you have not requested an absentee ballot, you may cast your vote on Election Day, Tuesday, November 2, 2021 or on Early Voting Day, Saturday, October 30, 2021. 

5. Where can I cast my vote for the Charter Amendments?

On Election Day, Tuesday, November 2, 2021.

 

If you vote in precinct numbers 70, 72, or 76 you will vote at the Live Oak Community Center (901 Live Oak Reserve Boulevard) 

If you vote in precinct numbers 74, 75, or 80 you will vote at Riverside Park (1600 Lockwood Boulevard)

If you vote in precinct numbers 68, 69, 71, or 78 you will vote at Oviedo City Hall (400 Alexandria Boulevard)  

On Early Voting Day, Saturday, October 30, 2021.

All City precincts will vote at Oviedo City Hall (400 Alexandria Boulevard) 

6. What questions will be on the ballot?

There will be four Charter Amendment questions on the ballot.

1. Shall Oviedo’s charter be amended to increase the term of office for City Councilmembers from two (2) to four (4) years beginning with the 2024 election and providing for three (3) year terms for City Councilmembers elected in the 2023 election in order to allow for a two year election cycle that will coincide with statewide elections?

2. Shall Oviedo’s charter be amended to increase the annual debt issuance limit from $5,000,000 to $10,000,000; Provide that such debt issuance limit does not apply to debt secured by enterprise funds or associated with leases; and to remove an antiquated provision related to the purchase of the assets of Alafaya Utilities, Inc.?

3. Shall Oviedo’s charter be amended to correct typographical errors; increase number of petition signatures needed to qualify for City Council from 25 to 150; clarify the due date for filing nominating petitions and adjust the time frames for holding all special elections?

4. Shall Oviedo’s charter be amended to remove the requirement for the posting of a bond by the city manager, allowing for the city manager to hire the city clerk, and by correcting a typographical error in Section 4.07?

7. How were the four ballot questions chosen?

At its February 17, 2020 meeting, the Oviedo City Council adopted Resolution Number 3982-20 establishing a Charter Review Committee. The Committee was given the task of performing a comprehensive review of the City's Charter and recommend revisions and/or amendments to the City Council. 

The Committee met and deliberated over several items within the Charter; recommending four questions to the City Council. At its June 21, 2021 meeting, the Oviedo City Council unanimously passed Ordinances 1704, 1705, 1706, and 1707 sending them to the ballot.
